This Expoverse Privacy Policy ("Privacy Policy") applies to the official Expoverse website ("Expoverse Site"), Expoverse market and stores ("Expoverse Marketplace"), Expoverse mobile app ("Expoverse App"), and/or software provided by Expoverse in connection with any of the foregoing as well as the associated webpages, interactive features and functions made available by Expoverse (referred to individually and collectively herein as "Expoverse Services"), and any other website or service platform that links to this Privacy Policy (referred to collectively herein as "Expoverse Network").
The Expoverse Services are provided and controlled by Expoverse Entertainment Group LLC dba Expoverse (est. 2013) of 1580 N Logan St Suite 660 PMB 48256, Denver, CO 80203-1994, United States ("Expoverse", "we", "us", or "our"). In countries where privacy laws use the concept of data controller and processor, for example in the European Economic Area ("EEA"), Expoverse will be what’s known as the "Controller" of the Personal Information you provide to us related to your Expoverse Account and to the delivery of Expoverse Products and Services to you.
When Expoverse processes Expoverse Account data and Expoverse Marketplace data, we are acting as a controller. Expoverse is also a controller for our employees’ Personal Information. When Expoverse processes User Content, Expoverse is acting as a processor. Expoverse processes these categories of Personal Information differently because the direct relationship Expoverse has with our members and customers (clients), is different from the indirect relationship we have with our end users.
Your privacy is important, and Expoverse recognizes that users have legitimate concerns about privacy with respect to use of use Expoverse Services. All Expoverse employees, agents, partners and contractors are responsible for protecting Personal Information collected and processed by Expoverse, and to assist in the protection of Personal Information by acting in accordance with this Privacy Policy.
This Privacy Policy sets forth Expoverse's practices regarding the collection and use of the Personal Information of Users and other individuals in connection with our Expoverse Services, as well as the choices Expoverse offers you regarding the use of this information with respect to Expoverse's Network. "Personal Information" is data that can be used to uniquely identify or contact you, including, for example, your name, address, phone number, Password, and email address. This Privacy Policy only addresses Expoverse's activities from its servers. 1.1 Expoverse collects data about you depending on how much you decide to share with us or make publicly accessible (e.g. via social media). This might be a simple IP address or cookie, or we may collect a variety of Personal Information, including, without limitation to, your name, mailing address, phone number, email address, credit card number, and contact preferences when you:
- (a) access the Expoverse website (expoverse.com), register for Expoverse Services, or open an Expoverse Account;
- (b) sign up for special offers from selected Third Parties;
- (c) enter into a sweepstakes or participate in contests sponsored by Expoverse or one of Expoverse's partners;
- (d) send email messages, Submit forms or send other information to Expoverse;
- (e) use or purchase products and services through Expoverse or one of Expoverse's partners;
- (f) anytime you are in contact with Expoverse or an Expoverse affiliated company; and/or
- (g) anytime you attend any of our Expoverse LIVE ("EV LIVE") events.
1.2 Personal Information.
Expoverse may collect Personal Information from you at other points on Expoverse's Site that state that Personal Information is being collected. Expoverse may also receive certain Personal Information from some of Expoverse's Third Party partners. Expoverse's servers automatically collect information about which Expoverse Site locations Users visit and which Expoverse Sites are viewed within the Expoverse Network. Expoverse uses a feature of your browser called a "cookie" to assign a User ID that automatically identifies your computer when you visit the site. Expoverse may also use cookies placed by Third Party servers to target the advertising delivered to you. This practice is common in Internet advertising.
1.3 User Content.
Expoverse may collect the content you create, upload, generate, or access through the Expoverse Services, including the photographs, images, audio recordings, and videos you upload, ai content you generate, comments you make, and other actions you take on the Expoverse Services, such as sharing content, including associated metadata (such as when, where, and by whom the content was created) ("User Content"). To provide personalized experiences we may recommend User Content to improve your experience. You are not required to create an Expoverse Account when using our Expoverse Services, but some of the functionality will be limited if you do not create an Expoverse Account. Additionally, Expoverse collects information, including text, images, and videos, found in your device’s clipboard, with your permission. For example, if you choose to initiate information sharing with a Third Party platform, or choose to paste content from the clipboard onto the Expoverse Services, Expoverse accesses this information stored in your clipboard in order to fulfill your request. Expoverse may also collect information about you where you choose to use the Services without creating an Expoverse Account, as otherwise described in this Privacy Policy.
1.4 Purchase Information.
If you use features that involve payment (e.g. when you purchase something from our store), including rewards programs, as described in our Expoverse Terms of Service, as part of the buying and selling process, Expoverse and/or our service providers or business partners, such as payment providers, may collect Personal Information about the purchase or payment transaction, such as payment card information, billing, delivery, email address, and contact information, and what you purchased, where required for the purpose of payment. When you browse the Expoverse Marketplace Catalog (our co-branded shopping cart system), Expoverse also automatically receives your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.
1.5 Expoverse may also collect your feedback about the Expoverse Services if you choose to provide it, such as information you share through surveys or your participation in challenges, research, promotions, marketing campaigns, events, or contests such as your gender, age, likeness, and preferences.
1.6 Expoverse may collect information about the videos, images and audio that are a part of your User Content, such as identifying the objects and scenery that appear, the existence and location within an image or video of face and body features and attributes, the nature of the audio, and the text of the words spoken in your User Content. Expoverse may collect this information, for example, to recommend and moderate content, to serve you personalized ads where permitted, and to enable image and video effects. Once an effect that uses face or body information has been applied to your content, that information is deleted and not retained. Expoverse does not use any face or body information to identify you or other people in your content, and we do not share such information with Third Parties.
1.7 Where available, and if you choose to sign-up or log-in to the Expoverse Services using a Third Party service (e.g. Apple, Facebook, LinkedIn, or Google), such services provide Expoverse with information such as your profile information, including your username, email, and profile picture.
1.8 Expoverse may obtain information about you from certain affiliated entities within our corporate group, including about your activities on their platform.
1.9 Expoverse may receive information about you from others, for example, where you are included or mentioned in User Content, in a complaint, appeal, request or feedback submitted by a user or Third Party, or if your contact information is provided to us by a user.
2.1 Expoverse may collect, use, transfer, and disclose Personal Information for any purpose, including, without limitation to:
- (a) send important notices, such as communications about purchases and changes to Expoverse's terms, conditions, and policies. Because this information is important to your interaction with Expoverse, you may not opt out of receiving these communications;
- (b) internal purposes such as auditing, troubleshooting, data analysis, research, statistical and survey purposes;
- (c) Expoverse and its Affiliates may also share Personal Information with each other and use it consistent with this Privacy Policy. They may also combine it with other information to provide and improve Expoverse's Products, Services, Content and advertising;
- (d) to anticipate and resolve problems with your Service;
- (e) to investigate activity that may violate Expoverse's Terms of Service;
- (f) to develop and market Expoverse Products and Services that may be of interest to you. With your permission, Expoverse may send you emails about our store, new products and other updates;

2.2 If you indicate that you would like to receive information about products and services from Third Parties, Expoverse may disclose your Personal Information to these parties. You should note that Personal Information that you voluntarily disclose in forums, in chat rooms and in other Public areas of Expoverse's Site may be used by Third Parties.
2.3 If you choose to sign up or log in to use the Expoverse Services with your social network account details or other Third Party service account details or choose to link your Expoverse Services account with other social network accounts, these Third Party services may be able to collect information about you, including information about your activity on the Expoverse Services, and they may notify your connections on the Third Party services about your use of the Expoverse Services, in accordance with their privacy policies. If you choose to allow a Third Party service to access your Expoverse Services account, we will share certain information about you with the Third Party service, such as your username/ID, access token, and the referring URL. Where you opt to share User Content you created or uploaded on the Expoverse Services to other social media Services, your User Content, username and accompanying text (if any) will be shared on such Services.
2.4 If you are an existing Expoverse vendor/merchant ("Product Provider") using Expoverse Services for customers to review and order your products, and to pay you, Expoverse may contact you via email, text message (SMS), telephone, paper mail, and send notifications to your Expoverse Marketplace dashboard and/or Expoverse Account control panel, for the purpose of helping manage your account, delivering important information to you, and marketing Expoverse Products and Services. If you are inquiring about our payment services, we may contact you via email or telephone to answer questions you may have about how Expoverse Services work.
2.5 Expoverse may share the types of information we collect with law enforcement agencies, public authorities, or other entities if legally required to do so, or if we have a good faith belief that such use is reasonably necessary to:
- (a) comply with any applicable laws, regulations, codes of practice, governmental guidelines, or other legal and regulatory obligations, as consistent with internationally recognised standards;
- (b) enforce our Terms of Service and other agreements, policies, and standards, including investigation of any potential violation thereof;

2.6 Expoverse may also disclose your information to Third Parties in the event that we sell any business or assets, in which case Expoverse may disclose your information to the prospective buyer of such business or assets; or if we sell, buy, merge with, are acquired by, or partner with other companies or businesses, or sell some or all of our assets. In such transactions, your user information may be among the transferred assets.
3.1 To protect your personal information, Expoverse takes reasonable precautions and follows industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. All the personal data we process is processed by our staff in the United States, and maintenance of this information is located on servers within the United States on a secure server behind a firewall. No Third Parties have access to your Personal Information unless the law allows them to do so. Expoverse has a Data Protection regime in place to oversee the effective and secure processing of your Personal Information.
3.2 Once Expoverse has received a transmission of information, Expoverse takes reasonable precautions including administrative, technical, and physical measures to safeguard and preserve the integrity and security of your Personal Information against loss, theft, and misuse, as well as against unauthorized access, disclosure, alteration, and destruction, however, please note that this is not a guarantee that any such forementioned breach cannot or will not occur.
3.3 If Expoverse discovers or learns of a breach in its security systems, then Expoverse may attempt to notify you electronically so that you can take appropriate protective measures, and Expoverese may Post a notice on the Expoverse Site.
3.4 When you use some Expoverse Services, or Post on an Expoverse forum, chat room, or other Public Area of the Expoverse Site, the Personal Information you share is visible to other users and can be read, collected, or used by them. You are responsible for the Personal Information you choose to Submit in these instances.
4.1 Expoverse has made it very easy for you to keep your Personal Information accurate, complete, and up to date, and Expoverse takes steps to ensure that your information is retained for as long as it is necessary to provide you with the Expoverse Services and for the other purposes set out in this Privacy Policy. If you choose to use the Expoverse Media Cloud Service, Expoverse will delete the content or information you have actively uploaded and stored in the Expoverse Media Cloud Service at your request and as otherwise permitted by law or regulation. Expoverse retains information when necessary to comply with contractual and legal obligations, when we have a legitimate business interest to do so (such as improving and developing the Expoverse Site and the TAC Platform, and enhancing safety, security and stability), to protect the rights of others, and for the exercise or defense of legal claims.
5.1 You can help Expoverse ensure that your contact and other information and preferences are accurate, complete, and up to date by logging in to your Expoverse Account(s) at https://www.expoverse.com/login. For other Personal Information, Expoverse makes good faith efforts to provide you with access so you can request that Expoverse correct the data if it is inaccurate or delete the data if Expoverse is not required to retain it by law or for legitimate business purposes.
5.2 Expoverse reserves the right to, and may, decline to process requests that are unreasonably repetitive, require disproportionate technical effort, jeopardize the privacy of others, are extremely impractical, or for which access is not otherwise required by local law. 6.1 Expoverse may collect a variety of Non-Personal Information in a form that does not permit direct association with any specific individual. Expoverse may also collect, use, transfer, and disclose Non-Personal Information for any purpose, including, without limitation to:
- (a) collecting general information such as occupation, language, zip code, area code, location so that Expoverse can better understand Visitors and Customer behavior and improve Expoverse Products, Service, and advertising.
- (b) collecting general information regarding Expoverse Customer activities on the Expooverse Site. This information is aggregated (aggregated is considered Non-Personal Information for the purposes of this Privacy Policy) and used to help Expoverse provide more useful information to its Visitors and Customers and to understand which part/s of the Expoverse Site and Expoverse Services are most popular.
6.2 If Expoverse does combine Non-Personal Information with Personal Information the combined information will be regarded as Personal Information for as long as it remains combined.
7.1 Children under the age of 13 are not eligible to use Expoverse or enter its contests without verifiable parental consent and should never reveal their addresses, phone numbers or other Personal Information to any strangers on the Internet. Expoverse does not knowingly collect Personal Information from children under 13. If Expoverse learns that Expoverse has collected the Personal Information of a child under 13 (without verifiable parental consent) Expoverse will take steps to delete the information as soon as possible. If you believe that Expoverse has collected Personal Information from a minor under the minimum age, please contact us using the contact information found in the "Contact Us" section.
8.1 The Expoverse Site, Products, Apps, and Services featured at the Expoverse Site may contain links to Third Party websites, products, and services. Expoverse Services may also use or offer products or services from Third Parties. Information collected by Third Parties, which may include such things as location data or contact details, is governed by their privacy practices. Expoverse recommends that you to learn about the privacy practices of those Third Parties.
9.1 International Users.
Expoverse (the data controller) is hosted within the United States, and if you access Expoverse from any other region/s of the world with laws governing data collection and use, then please note that you are transferring your personally identifiable information outside of those regions and into the United States and by providing such information you are consenting to that transfer. Also, any information that you provide to Expoverse may be transferred or accessed by entities around the world as described in this Privacy Policy.
9.2 EU/EEA General Data Protection Regulation (GDPR).
The General Data Protection Regulation ("GDPR" or French RGPD) is a European Union regulation on information privacy in the European Union (EU) and the European Economic Area (EEA). The GDPR provides the following rights to data subjects, i.e. individuals whose data is processed:

Expoverse will respond and/or fulfill your requests for the exercise of your rights below, according to the applicable law and when applicable, to the Brazilian General Data Protection Law - LGPD:

9.4 When you decide to exercise one of your rights, Expoverse will respond within one month, however depending on the complexity of the request more time may be needed to answer, in which case Expoverse may extend the time limit by informing you of any such situation within one month after receiving the request. If Expoverse believes that the data request is manifestly unfounded or too excessive, in particular because of its repetitive character, Expoverse may either charge a reasonable fee or refuse to grant the request. If Expoverse has reasonable doubts about the identity of the person making the request (for example the request is made from an email address other than the one registered to the Expoverse Account, or it is made outside of an authenticated Expoverse Account, we may request additional information for identity confirmation prior to any response to the exercise of such rights, for instance Expoverse may request that you verify your identity by providing either any or all of the following information in accordance with the laws in each country:

10.1 Expoverse's Site, online Services, interactive Apps, email messages, and advertisements may use "cookies" and other technologies such as pixel tags and web beacons in order to:
- (a) help Expoverse better understand Visitor and Customer activity on the Expoverse Site;
- (b) to tell Expoverse which parts of its Expoverse Site/Network people have visited; and
- (c) to facilitate and measure the effectiveness of Expoverse's advertisements.
10.2 Expoverse treats information collected by cookies and other technologies as Non-Personal Information. However, to the extent that Internet Protocol (IP) addresses or similar identifiers are considered Personal Information by local law, Expoverse also treats these identifiers as Personal Information. Similarly, to the extent that Non-Personal Information is combined with Personal Information, Expoverse treats the combined information as Personal Information.
10.3 Expoverse and its partners also use cookies and other technologies in Expoverse Advertising Services to control the number of times you see a given ad, deliver keyword/s relative ads, and measure the effectiveness of ad campaigns. Expoverse Advertising Services cookies are based on Non-Personal Information.
10.4 As is true of most websites, Expoverse gathers some information automatically and stores it in log files. This information includes Internet Protocol (IP) addresses, browser type and language, Internet Service provider (ISP), referring and exit pages, operating system, date/time stamp, and clickstream data. Expoverse uses this information to understand and analyze trends, to administer the site, to learn about User behavior on the site, and to gather demographic information about Expoverse's User base as a whole. 10.6 Pixel tags, also known as clear GIFs, web beacons, or pixels, allow Expoverse to do things like read and place cookies. 11.1 At times Expoverse may make certain Personal Information available to strategic partners that work with Expoverse to provide Products and Services, or that help Expoverse market to Customers. 11.2 Expoverse may share Personal Information with companies who provide services such as information processing, processing Expoverse Customer orders and delivering Expoverse Products to you (order fulfillment), managing and enhancing Expoverse Customer data, providing Expoverse Customer service, assessing your interest in Expoverse Products and Services, and conducting surveys.
